A review of domestic and international laws and treaties relating to coastal management, pollution, protected areas, endangered species, fish, marine mammals, wetlands, and seabed mineral and hydrocarbon resources.
The course considers how effectively these legal authorities blend together to provide rational and comprehensive management and protection of marine. We will examine U.S. law and policy regimes as they relate to beaches, coastal wetlands, and near-shore ocean environments, focusing on both federal and California state law and policy.
Coastal and ocean resources are governed by a complex array of policies; among the legal authorities we will discuss are: the Clean Water Act, Oil Pollution Act. The course emphasizes conflicts between public and private uses of the coastal zone, state and federal conflicts, and natural resource issues.
Specific topics covered in the course include coastal management, beach access and public trust, fisheries law and the law of the sea, protection of marine mammals, and ocean renewable energy development.
